The E-2 Visa is a U.S. nonimmigrant visa designed for investors from countries that maintain a treaty of commerce and navigation with the United States.
Key Features of the E-2 Visa:
Purpose: Allows foreign nationals to enter the United States to develop and direct a business in which they have made a substantial investment.
Investment: While no minimum investment amount is specified by law, the capital must be substantial relative to the nature of the business. In practice, investments typically start at around USD 100,000, though this may vary.
Business Control: The investor must own at least 50% of the enterprise or otherwise maintain operational control.
Active Enterprise: The business cannot be merely speculative; it must be an active, operating enterprise that creates jobs or has a positive economic impact.
Duration: Generally issued for a period of 2 to 5 years, depending on the applicant’s nationality, with unlimited renewals as long as the enterprise remains active.
Dependents: Spouses and unmarried children under 21 may accompany the principal applicant. The spouse is eligible for work authorization in the U.S., while children may study but are not permitted to work.
Not a Green Card: The E-2 is a renewable temporary residence visa and does not directly lead to permanent residency.
